1. Sponsorships.
This program, hereinafter the “Program” is sponsored by Oticon, Inc., Oticon A/S, a limited liability company, registered in Copenhagen under registration No. 42334219 and having its registered address at Kongebakken 9, 2765 Smørum, Copenhagen, Denmark or any corporation or other entity controlled by Oticon A/S or affiliated to Oticon A/S, hereinafter “Oticon.”
2. Participation Feedback Eligibility.
The Program is eligible to approximately sixty (60) individuals who purchase an Opn S hearing aid from a Participating Provider for the first time (“Eligible Participant”). Participating Providers are chosen by Oticon. Program is open to legal residents of the United States who are eighteen (18) years or older at the time of purchase. Program is void to persons who are covered by VHA benefits, Employees of Oticon Inc., its affiliates, licensees, franchisees, advertising and promotional agencies and the immediate family members of each are not eligible.
3. Entry Procedures.
To enter the Program, an Eligible Participant must complete the online sign up form after purchasing an Opn S hearing device/s from a Participating Provider.
4. Duties of Participants; Limitation of Liability.
By entering, participants agree to be bound by these rules and the decisions of Oticon which shall be final. All federal, state, and local laws apply. Oticon and the employees, officers, directors, shareholders, agents, and representatives of Oticon, affiliates, subsidiaries, and advertising, promotion and legal advisors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, or difficulties; (iii) errors in transmission; (iv) any condition caused by events beyond the control of Oticon that may cause the Program to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind from participation in the Program; or (vi) any printing or typographical errors in any materials associated with the Program. Participants agree to provide feedback on experience to the best of their ability.
5. Permissions.
Except where prohibited by law, purchase constitutes permission to use Eligible Participant’s name, hometown and likeness for online posting, and/or any advertising and publicity without additional compensation. Eligible Participants may also be required to sign and return a release of liability, declaration of eligibility and, where lawful, a publicity consent agreement.
6. Third Party interactions.
Oticon may use information about Eligible Participants:
- To contact Eligible Participants with information about products, services, events, education, and research opportunities directed at Eligible Participant’s interests.
- To provide Eligible Participants with information that they have requested from Oticon or that Oticon thinks may be of interest to Eligible Participant.
- To ask for Eligible Participant’s input to help in Oticon research about its products.
During the Program, Eligible Participant may enter into correspondence with, purchase goods and/or services from, or participate in programs of advertisers or sponsors showing their goods and/or services through the third party. Any such activity, and any terms, conditions, warranties or representations associated with such activity, is solely between Eligible Participant and the applicable third-party. Oticon shall have no liability, obligation or responsibility for any such correspondence, purchase or promotion between Eligible Participant and any such third party. Oticon does not endorse any sites on the Internet that are linked through its Website. Oticon provides these links to you only as a matter of convenience, and in no event shall Oticon be responsible for any content, products, or other materials on or available from such sites. Oticon provides the Program to you pursuant to these terms and conditions. Eligible Participant recognizes, however, that certain third-party providers of ancillary software, hardware or services may require Eligible Participant’s agreement to additional or different license or other terms prior to your use of or access to such software, hardware or services.
