1. Sponsorships.
This promotion, hereinafter the “Promotion” is sponsored by Oticon, Inc., a California corporation and having its registered address at 580 Howard Avenue, Somerset, NJ 08873, hereinafter “Oticon.”
2. Participation Eligibility.
The Promotion is open to persons (“Eligible Participant(s)”) who meet the following criteria: (1) the person has purchased Oticon Intent™ 1 hearing aids during the Qualification Period from a qualified Oticon hearing care professional, (2) the person is a current hearing aid user but has not previously worn an Oticon Intent hearing aid, (3) the person is a US citizen or permanent resident, (4) The person currently wears an Oticon More™, Oticon Real™, or non-Oticon prescription hearing aid, not including Sonic, Bernafon, or Philips brand hearing aid(s), and (5) the person did not receive or purchase the Oticon Intent 1 hearing aids or any related services from, through, or as a part of (i) any federal or state subsidized programs, including, but not limited to, Medicare, Medicaid or the VA, or (ii) Voc Rehab, Nations Benefits/Nations Hearing, EPIC/United Hearing, TruHearing Choice, Hearing Care Solutions, HearUSA, AudioNet, Great Lakes Provider Network, AZ Hear Care Network, Amplifon Hearing Health Care, Simpli Hearing, VA Community Care/VA Choice, United Hearing — AARP, any non-profit organization offering discounted, waived, subsidized, or free pricing, HearingLife, Kaiser Permanente, or any organization that claims to offer Oticon Intent 1 equivalents as a private label product. Eligible Participants will receive a three hundred dollar (USD$300.00) manufacturer’s rebate for the purchase of a set (2 individual) of Oticon Intent 1 hearing devices and a one hundred fifty dollar (USD$150.00) manufacturer’s rebate for the purchase of a single Oticon Intent 1 hearing aid. The rebate may be in cash or a cash equivalent gift card, at Oticon’s discretion. This Promotion is only open to legal residents of the United States who are eighteen (18) years or older at the time of purchase; however, the Promotion is void in states where otherwise prohibited or restricted by law. This Promotion is open to purchases made in the United States only. The employees of Oticon, and the employees of its affiliates, licensees, advertising and promotional agencies and the immediate family members of each are not eligible to participate in this Promotion. This Promotion is limited to: 1 rebate per person and per purchase.
3. Qualification Period.
The Qualifying Purchase Period for this Promotion begins at 12:01am (EST) on January 1, 2025 and ends at 11:59pm (EDT) on December 31, 2025.
4. Entry Procedures.
To enter this Promotion: (i) an Eligible Participant must purchase Oticon Intent 1 hearing devices during the Qualification Period from a “Qualified Oticon Hearing Care Professional,” and (ii) complete and submit a valid online rebate form within two (2) months of the purchase of the hearing aids. A “Qualified Oticon Hearing Care Professional” is a hearing care provider located in the United States who appears on Oticon’s online Hearing Clinic Locator during the Qualification Period at: oticon.com/hearing-center-locator. As part of the rebate form, Eligible Participant must submit a photo demonstrating proof of visit to a Qualified Oticon Hearing Care Professional and purchase of Oticon Intent 1 hearing aids. This Promotion cannot be combined with any other offers, promotions or coupons. Eligible Participants will be issued a rebate within ninety (90) days of receipt of a valid online rebate form.
5. Disclaimers.
By entering, Eligible Participant agrees to be bound by these terms and conditions and the decisions of Oticon, which shall be final in all matters. All federal, state, and local laws apply. By entering this Promotion, Eligible Participants waive all right to, and hold harmless Oticon from, any claims, liabilities, losses, damages (including punitive, incidental, and consequential damages), or expenses (including attorneys' fees) arising out of or in connection with (i) entry and participation in this Promotion; (ii) the acceptance, use, or misuse of the rebate; (iii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware, software, or application; (iv) the unavailability or inaccessibility of any transmissions or telephone or internet service; (v) unauthorized human intervention in any part of the entry process or this Promotion; (vi) electronic or human error that may occur in the administration of this Promotion or the processing thereof. Oticon reserves the right to verify eligibility of all rebate claims and supporting documentation, including, without limitation, invoice documentation. Oticon will determine the validity of any and all rebate claims at its sole discretion and may refuse, disqualify, or withdraw any Eligible Participant at any time. Except where prohibited by law, acceptance of a rebate constitutes permission to Oticon to use that individual’s name, likeness, and biographical information for marketing purposes without further compensation or right of approval. Oticon reserves the right to modify the rules of this Promotion or cancel this Promotion at any time, for any reason, in its sole discretion.
6. Distribution of Manufacturer Rebate.
Rebates will be given in the amount of three hundred dollars (USD$300.00) for a purchase of a set (2 individual) of Oticon Intent 1 hearing devices and in the amount of one hundred fifty dollars (USD$150.00) for the purchase of a single Oticon Intent 1 hearing aid. Rebates will be approved by Oticon, or through the fulfillment services of a third party agency designated by Oticon within ninety (90) days of receipt of a valid online rebate form submission. Upon issuance, Oticon transfers to Eligible Participant full ownership, title and possession of the rebate. Oticon is not responsible for rebates lost, stolen, or damaged in transit and has no obligation to replace rebates or reimburse Eligible Participant. Rebates not redeemed within sixty (60) days or returned as undeliverable may be deemed forfeited.
7. Third Party interactions.
During this Promotion, you may enter into correspondence with, purchase goods/services from, or participate in promotions offered by third party advertisers or sponsors. Any such activity, and any terms, conditions, warranties or representations associated with such activity, is solely between you and the applicable third party. Oticon shall have no liability, obligation, or responsibility for any such correspondence, purchase, or promotion between you and any such third party. Oticon does not endorse any sites on the Internet that are linked through its website. Oticon provides these links to you only as a matter of convenience, and in no event shall Oticon be responsible for any content, products, or other materials on or available from such websites. Oticon provides this Promotion to you pursuant to the terms and conditions set forth herein. You recognize, however, that certain third party providers of ancillary software, hardware, or services may require your agreement to additional or different license or other terms prior to your use of or access to such software, hardware, or services.
All users have the option to discontinue receiving communications from Oticon. To discontinue or unsubscribe from Oticon email communications click the unsubscribe link at the bottom of the email communication. If you wish to unsubscribe or opt-out from any third party websites, you must go to that specific email to unsubscribe and/or opt-out.
8. Choice of Law and Forum.
Entrant agrees that all matters arising out of or relating to this Promotion and these terms and conditions are governed by, and construed in accordance with, the laws of the State of New Jersey, without giving effect to any of its conflict of laws provisions thereof. Entrant further agrees that any legal suit, action, or proceeding arising out of or relating to this Promotion and these terms and conditions shall be brought exclusively in the applicable federal or state courts located in New Jersey.
9. Data Collection, Use and Sharing.
By submitting your information, you acknowledge and agree to the following:
Purpose of Data Collection
To process your rebate request and manage the rebate program, we request your personal information, which includes your name, phone number, home address, email address, purchase information, and a picture of proof of purchase such as but not limited to a purchase agreement or visit summary.
Use of Your Information
The use of your information will be for verification of your eligibility for the rebate, communication regarding your rebate request, and for enhancements of our rebate program.
Sharing Your Information
Your information will be shared with our third-party service provider 360insights for program administration, their subcontractors who are providers who assist with processing your information, and government or regulatory authorities upon their request.
Cross-Border Processing and Storage
Your personal information may be processed, stored, and accessed by 360insights and their subcontractors in countries outside the United States, including but not limited to European Union, Canada, or other jurisdictions.
Your rights
Depending on your jurisdiction, you may have the right to access the personal information held about you, request corrections and/or deletion of your personal information or withdraw your consent at any time by emailing privacy@360insights.com.
Retention of Personal Information
Your personal information will be retained only for as long as necessary to fulfill the purposes outlined in this notice and as required by law.
Data Security
We take all reasonable and appropriate measures to protect your personal information from unauthorized access, use and disclosure.
360insight uses appropriate safeguards to protect your information during cross-border transfers, including but limited to encryption, contractual agreements (such as Standard Contractual Clauses), data minimization, vendor assessments, and regular audits to ensure compliance with applicable GDPR and US privacy laws.
