Privacy Policy

By accessing and using the www.myoticon.com website (“MyOticon” or the “Site”), you (“you” or “User”) (i) represent that you are an authorized representative of a company that is an existing customer (“Customer”) of Oticon, Inc. (“Oticon,” “we,” “us,” or “our”), and that such Customer has received from Oticon the necessary user ID and password to access the Site; and (ii) agree to be bound by the terms of this Privacy Policy and the Site’s terms of use (“Terms of Use”).

This Privacy Policy sets forth Oticon’s policy with respect to information we collect from Users on the Site.  We have created this Privacy Policy, because we know that you and your company care about how information and data you provide to us online are collected and used.  

 

The Information We Collect

When you use MyOticon, you may provide us with personally identifiable information about (1) you and/or your company, such as name, title, e-mail address, postal address, and telephone number (collectively, the “Customer Information”) and/or (2) your customers, such as name, age, Medicaid number, insurance ID number, last four digits of their Social Security number, and hearing test results (collectively, the “Purchaser Information”).  We do not collect any Customer or Purchaser Information from you when you visit the Site unless you provide us with such information voluntarily (for example, by placing an order or sending us a message).

In an ongoing effort to better understand our Users, we may automatically collect other types of non-personally identifiable information when you visit the Site, such as your network location, the IP address of your computer, what sections of the Site you visit, and what navigation you perform.

Also, the Site may use “cookie” technology to help us collect other non-personally identifiable information and to enhance your experience using the Site.  Cookies are small packets of data that a web site stores on your computer’s hard drive so that your computer will “remember” information about your visit.  If you do not want the Site to place a cookie on your hard drive, you may be able to turn that feature off on your computer.  Please consult your Internet browser’s documentation for information on how to do this.  However, if you decide not to accept cookies from our Site, the Site may not function properly.

How We Use and Share Purchaser Information

Below are the limited conditions under which we may use and/or share Purchaser Information:

Provision of Services and Support.  Oticon will use Purchaser Information as required to fulfill its obligations under Customer orders or subsequent requests for service and/or support by our Customers.  In so doing, Oticon may outsource to third parties’ certain services, in whole or in part, from time to time.  These other companies will have access to the Purchaser Information only as necessary to perform their functions and only to the extent permitted by law.

 

Maintenance and/or Upgrades to the Site.  Oticon’s technical staff may require periodic access to Purchaser Information to monitor Site performance, test and fix the Site, and develop and implement upgrades to the Site.  Any temporary copies of Purchaser Information created as a necessary part of this process are maintained only for periods of time relevant to those purposes.

Change of Control/Sale of Assets.  If we or any of our affiliated companies (or all or substantially all of our assets or the assets of any of our affiliated companies) are acquired, we expect that Purchaser Information would be transferred along with the other business assets.

Legal Requirements.  To the extent permitted by law, we may also disclose Purchaser Information when required by law, court order, or other government or law enforcement authority or regulatory agency, or whenever we believe that disclosing Purchaser Information is necessary or advisable, for example, to protect the rights, property, or safety of Oticon or others.

How We Use and Share Customer Information

We will use and share Customer Information for the same reasons and in the same manner that we use and share Purchaser Information.  In addition, we may use Customer Information to contact you about the products, services, and/or events about which you have expressed interest.  We may also use Customer Information to inform you about other products, services, and/or events that may be available through Oticon.  

Accessing and Modifying Customer Information

Users who have provided Customer Information via the Site may access, remove, review, and/or make changes to their Customer Information at any time by accessing the My Account section of the Site.

How We Protect Purchaser and Customer Information

We maintain reasonable physical, electronic, and procedural safeguards to secure the Purchaser and Customer Information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction.  In addition, we use standard security protocols and mechanisms in the transmission of sensitive data.  However, we are unable to guarantee that security measures we take will not be penetrated or compromised or that the Purchaser and/or Customer Information will remain secure under all circumstances.

External Web Websites

The Site may contain links to third-party web sites.  Oticon has no control over the privacy practices or the content of any of our business partners, advertisers, sponsors, or other web sites to which we provide links from the Site.  As such, Oticon is not responsible for the content or the privacy policies of web sites to which our Site may link.  You should check the applicable privacy policy of the web site sponsor when visiting any other web sites.

Changes to This Privacy Policy

This Privacy Policy is effective as of the date stated at the top of this Privacy Policy.  We may change this Privacy Policy from time to time.  By accessing this Site after we make any such changes to this Privacy Policy, Customers and Users are deemed to have accepted such changes.  Please be aware that, to the extent permitted by applicable law, our use of Purchaser and Customer Information is governed by the Privacy Policy in effect at the time we collect such Purchaser and/or Customer Information.  Please refer back to this Privacy Policy on a regular basis.
