1. Sponsorships.
This promotion, hereinafter the “Promotion” is sponsored by Oticon, Inc., a California corporation and having its registered address at 580 Howard Avenue, Somerset, NJ 08873, hereinafter “Oticon.”
2. Participation Eligibility.
The Promotion is open to persons (“Eligible Participant(s)”) who meet the following criteria: (1) the person has purchased Oticon Real 1 hearing aids during the Qualification Period from a qualified Oticon hearing care professional, (2) the person has not previously worn an Oticon, Sonic, or Philips brand hearing aid and, (3) the person is not a part of (i) any federal or state subsidized programs, including, but not limited to, Medicare, Medicaid or the VA, or receiving benefits/services from (ii) Voc Rehab, Nations Benefits/Nations Hearing, EPIC/United Hearing, TruHearing Choice, Hearing Care Solutions, HearUSA, AudioNet, Great Lakes Provider Network, AZ Hear Care Network, Amplifon Hearing Health Care, Simpli Hearing, VA Community Care/VA Choice, United Hearing – AARP, Non-profit pricing, HearingLife, Kaiser Permanete or private label products. Eligible Participants must accurately complete and submit the online rebate form by March 31, 2024. Hearing aid units returned within 30 days after form submission are not eligible for this promotion. Eligible Participants will receive a two hundred dollar (USD$200.00) manufacturer’s rebate check for the binaural purchase of Oticon Real 1 hearing devices and a one hundred dollar (USD$100.00) manufacturer’s rebate check for the purchase of a single Oticon Real 1 hearing aid. This Promotion is only open to legal residents of the United States who are eighteen (18) years or older at the time of purchase; however, the Promotion is void in states where otherwise prohibited or restricted by law. This Promotion is open to purchases made in the United States only. The employees of Oticon, and the employees of its affiliates, licensees, advertising and promotional agencies and the immediate family members of each are not eligible to participate in this Promotion. This Promotion is limited to: 1 check per person and per purchase.
3. Qualification Period.
The Qualification Period for this Promotion begins at 12:01 AM (EST) on July 24, 2023 and ends at 11:59 PM (EDT) on February 29, 2024. Completion of the online rebate ends at 11:59 PM (EDT) on March 31, 2024.
4. Entry Procedures.
To enter this Promotion: (i) an Eligible Participant must purchase Oticon Real 1 hearing devices during the Qualification Period from a Qualified Oticon Hearing Care Professional, and (ii) complete and submit a valid online rebate form by March 31, 2024. As part of the rebate form, a photo of the new Oticon Real 1 hearing aid(s) and the prior non-Oticon/Sonic/Phillips hearing aid will be required. This Promotion cannot be combined with any other offers, promotions or coupons. Eligible Participants will be mailed a rebate check within sixty (60) days of receipt of a valid online rebate form.
5. Disclaimers.
By entering, entrant agrees to be bound by these terms and conditions and the decisions of Oticon, which shall be final in all matters. All federal, state, and local laws apply. By entering this Promotion, entrants waive all right to, and hold harmless Oticon from, any claims, liabilities, losses, damages (including punitive, incidental, and consequential damages), or expenses (including attorneys' fees) arising out of or in connection with (i) entry and participation in this Promotion; (ii) the acceptance, use, or misuse of the rebate check(s); (iii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware, software, or application; (iv) the unavailability or inaccessibility of any transmissions or telephone or internet service; (v) unauthorized human intervention in any part of the entry process or this Promotion; (vi) electronic or human error that may occur in the administration of this Promotion or the processing of entries. Oticon reserves the right, at its sole discretion, to refuse, disqualify, or withdraw any entrant at any time. Except where prohibited by law, acceptance of a rebate check constitutes permission to Oticon to use that individual’s name, likeness, and biographical information for marketing purposes without further compensation or right of approval. Oticon reserves the right to modify the rules of this Promotion or cancel this Promotion at any time, for any reason, in its sole discretion.
6. Distribution of Manufacturer Rebate Checks.
Rebate checks will be given in the amount of two hundred dollars (USD$200.00) for a binaural purchase of Oticon Real 1 hearing devices and in the amount of one hundred dollars (USD$100.00) for the purchase of a single Oticon Real 1 hearing aid. Rebate checks will be shipped through the fulfillment services of the Adtrack Corporation at Oticon’s discretion within sixty (60) days of receipt of a valid online rebate form submission. Shipping will be via the most efficient shipping carrier, as determined by Adtrack. Upon shipment, Oticon transfers to Eligible Participant full ownership, title and possession of the rebate check. Oticon is not responsible for checks lost, stolen, or damaged in transit and has no obligation to replace checks or reimburse Eligible Participant. Checks not redeemed within sixty (60) days or returned as undeliverable will be deemed forfeited.
7. Third Party interactions.
During this Promotion, you may enter into correspondence with, purchase goods/services from, or participate in promotions offered by third party advertisers or sponsors. Any such activity, and any terms, conditions, warranties or representations associated with such activity, is solely between you and the applicable third party. Oticon shall have no liability, obligation, or responsibility for any such correspondence, purchase, or promotion between you and any such third party. Oticon does not endorse any sites on the Internet that are linked through its website. Oticon provides these links to you only as a matter of convenience, and in no event shall Oticon be responsible for any content, products, or other materials on or available from such websites. Oticon provides this Promotion to you pursuant to the terms and conditions set forth herein. You recognize, however, that certain third party providers of ancillary software, hardware, or services may require your agreement to additional or different license or other terms prior to your use of or access to such software, hardware, or services.
All users have the option to discontinue receiving communications from Oticon. To discontinue or unsubscribe from Oticon email communications click the unsubscribe link at the bottom of the email communication. If you wish to unsubscribe or opt-out from any third party websites, you must go to that specific email to unsubscribe and/or opt-out.
8. Choice of Law and Forum.
Entrant agrees that all matters arising out of or relating to this Promotion and these terms and conditions are governed by, and construed in accordance with, the laws of the State of New Jersey, without giving effect to any of its conflict of laws provisions thereof. Entrant further agrees that any legal suit, action, or proceeding arising out of or relating to this Promotion and these terms and conditions shall be brought exclusively in the applicable federal or state courts located in New Jersey.
