1. Sponsorships
This promotion, hereinafter the “Promotion” is sponsored by Oticon, Inc., Oticon A/S, a limited liability company, registered in Copenhagen under registration No. 42334219 and having its registered address at Kongebakken 9, 2765 Smørum, Copenhagen, Denmark or any corporation or other entity controlled by Oticon A/S or affiliated to Oticon A/S, hereinafter “Oticon.”
2. Participation Feedback Eligibility
The Promotion is eligible to persons who purchase an Opn S, Opn or Xceed hearing device/s within the Qualification Period (defined below) for fair market value from a Qualified Oticon Hearing Care Professional and who provide feedback to the best of their ability, hereinafter Eligible Participant.” Completion of the feedback in a timely and accurate manner is mandatory for eligibility. Eligible Participant will receive a single fifty dollar card compensation for both the purchase of a Opn S, Opn or Xceed hearing device/s and for the time incurred for their feedback survey. Promotion is open to legal residents of the United States who are eighteen (18) years or older at the time of purchase; however, the Promotion is void in states where otherwise prohibited or restricted by law. Promotion is void to persons who are covered by VHA benefits, state or federal Medicaid plans, or use federal or state funding, Employees of Oticon Inc., its affiliates, licensees, franchisees, advertising and promotional agencies and the immediate family members of each are not eligible. Limit: 1 gift card per person.
3. Qualification Period
The Qualification Period for the Promotion begins at 12:01 AM (EST) on January 1, 2020 and ends at 11:59 PM (EDT) on December 31, 2020.
4. Entry Procedures
To enter the Promotion, an Eligible Participant must provide feedback after purchasing an Opn S, Opn or Xceed hearing device/s within the Qualification Period for fair market value from a Qualified Oticon Hearing Care Professional. Promotion cannot be combined with any other offers, promotions or coupons.
5. Duties of Participants; Limitation of Liability
By entering, participants agree to be bound by these rules and the decisions of Oticon which shall be final. All federal, state, and local laws apply. Oticon and the employees, officers, directors, shareholders, agents, and representatives of Oticon, affiliates, subsidiaries, and advertising, promotion and legal advisors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, or difficulties; (iii) errors in transmission; (iv) any condition caused by events beyond the control of Oticon that may cause the Promotion to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind caused by a gift card or resulting from acceptance, possession, or use of a gift card, or from participation in the Promotion; or (vi) any printing or typographical errors in any materials associated with the Promotion.
6. Violation of Promotion Rules
Oticon reserves the right to disqualify any person or Eligible Customer who, in its sole suspicion, tampers with the entry process, intentionally violates these rules of this Promotion or attempts to interfere with the fair handling of this Promotion, or acts in an unsportsmanlike or disruptive manner.
7. Risk Free Trial
The no-cost Risk Free Trial, is administered solely and completely at the discretion of third party dispenser or retail location including but limited to the risk-free timeframe, cancellation periods, rates and auto charge. Oticon Inc. does not endorse or have any liability, obligation or responsibility to third party activity, terms, conditions, warranties or representations associated with such promotion. Risk Free Trial is solely between customer and the applicable third-party.
8. Distribution of Gift Cards
Gift cards will be given in the amount of Fifty dollars ($50.00), United States currency. Gift cards will be shipped through the fulfillment services of the Adtrack Corporation at Oticon’s discretion within sixty (60) days of purchase. Shipping will be via the most efficient shipping carrier, as determined by Adtrack. Upon shipment Oticon transfers to Eligible Customer full ownership, title and possession of gift card. Oticon is not responsible for gift cards lost, stolen, or damaged in transit and have no obligation to replace gift card or reimburse Eligible Customer. Except where required by law, this gift card is not redeemable for cash. Oticon is not responsible for the replacement of lost or stolen cards. Gift cards not redeemed within ninety days or returned as undeliverable will be deemed forfeited. Oticon reserves the right to substitute gift card of equal or greater value item in the event a gift card is unavailable. All taxes or fees on gift cards are Eligible Customer’s responsibility. All user rules and regulations established by VISA User Agreement hereby apply. Limit: 1 gift card per person.
9. Permissions
Except where prohibited by law, purchase constitutes permission to use Eligible Customer’s names, hometowns and likenesses for online posting, and/or any advertising and publicity without additional compensation. Eligible Customers may also be required to sign and return a release of liability, declaration of eligibility and, where lawful, a publicity consent agreement, as conditions of receiving a gift card. Failure to comply with the aforementioned conditions shall be grounds for forfeiture of a prize.
10. Third Party Interactions
We may use information about you:
- To contact you with information about products, services, events, education, and research opportunities directed at your interests.
- To provide you with information that you have requested from us or that we think may be of interest to you.
- To ask for your input to help in our research about our products.
During the Promotion, you may enter into correspondence with, purchase goods and/or services from, or participate in promotions of advertisers or sponsors showing their goods and/or services through the third party. Any such activity, and any terms, conditions, warranties or representations associated with such activity, is solely between you and the applicable third-party. Oticon shall have no liability, obligation or responsibility for any such correspondence, purchase or promotion between you and any such third party. Oticon does not endorse any sites on the Internet that are linked through its Website. Company provides these links to you only as a matter of convenience, and in no event shall Oticon be responsible for any content, products, or other materials on or available from such sites. Oticon provides the Promotion to you pursuant to the terms and conditions of this Agreement. You recognize, however, that certain third-party providers of ancillary software, hardware or services may require your agreement to additional or different license or other terms prior to your use of or access to such software, hardware or services.
